Failure to Diagnose Cancer


Unfortunately I've handled many failure to diagnose cancer cases and the one constant is clear, early detection is the key to successfully fighting cancer. Cancer symptoms can share the characteristics of other conditions, so proper testing by doctors is of the utmost importance. Certain tests such as PSA tests, mammograms and biopsies of questionable tissues or cells are commonly used to detect cancer and these alone may not be enough. Often times doctors fail to even order these crucial tests be performed. Instances also appear where the proper tests are ordered, but the pathologist misreads the slide or the radiologist misreads the film which leads to a delay in the diagnosis. Failing to diagnose cancer can worsen the treatment and can even be fatal.

In my years of experience in representing plaintiffs who have been injured or died as a result of medical malpractice for failure to diagnose cancer, cases involve:

Cancer is the uncontrolled growth of abnormal cells in the body. Cancerous cells are also called malignant cells. With cells being the building blocks of living things, you can see why cancer can have devastating and fatal results. Cancer grows out of normal cells in the body. Normal cells multiply when the body needs them, and die when the body doesn't need them. Cancer appears to occur when the growth of cells in the body is out of control and cells divide too quickly. It can also occur when cells forget how to die. There are many different kinds of cancers. Cancer can develop in almost any organ or tissue, such as the lung, colon, breast, skin, bones, or nerve tissue.

 There are many causes of cancers, including:

  • Smoking
  • Asbestos and other chemicals
  • Drinking excess alcohol
  • Excessive sunlight exposure
  • Genetic problems
  • Obesity
  • Radiation


However, the cause of many cancers remains unknown.
